Court Has Not Ruled on NDC Amenfi Central PCs Disqualification, EC Hastily Acted. A Renowned Ghanaian legal expert, Professor Kwaku Asare, commonly known as Kwaku Azar, has voiced concerns over the Electoral Commission’s (EC) decision to disqualify the National Democratic Congress’ (NDC) Parliamentary Candidate (PC) for Amenfi Central. According to him, the EC acted prematurely, as the court has not yet issued a final ruling on the matter.
Kwaku Azar criticized the EC for its apparent eagerness to disqualify the candidate without waiting for a clear legal directive. The candidate’s disqualification arose due to allegations of ineligibility, but the legal process concerning the issue is still ongoing. The professor argues that disqualification at this stage undermines the legal process and can lead to unnecessary legal disputes.
Azar emphasized that the rule of law should be the guiding principle for all institutions, particularly the EC, which has a crucial role in maintaining electoral integrity. He called for patience, urging the EC to allow the court to conclude its work before making any disqualification decisions.
He further expressed concern over the possible precedent the EC’s actions could set, as it may encourage premature decisions in future electoral disputes. Azar urged the EC to respect the judiciary’s role and avoid overstepping its authority.
In his opinion, such hasty moves by the EC could erode public trust in the electoral process and the institutions responsible for ensuring free and fair elections.
