⚖️ Jail Sentence Doesn’t Block Civil Lawsuits — Legal Expert Clarifies

Prominent legal practitioner, Obiri Boahen, has stated that the 15-year sentence handed to evangelist Nana Agradaa will not hinder ongoing or future court cases involving her, including the defamation suit filed by gospel artist Empress Gifty.

Speaking on Okay FM with host Nana Romeo on July 3, 2025, the lawyer stressed that Empress Gifty’s legal action remains valid and active, regardless of Agradaa’s incarceration.

“The case can proceed. Agradaa’s imprisonment for fraud and charlatanic advertisement does not exempt her from facing other lawsuits like Empress Gifty’s,” Boahen emphasized.

👩🏽‍⚖️ Court Can Proceed Without Her Physical Presence

Boahen explained that Ghana’s legal framework does not mandate a halt in proceedings just because a defendant is in prison.

“There is no law in Ghana that says cases must be paused because someone is serving time. Court sessions can continue whether the person is present or not,” he said.

If necessary, court orders can be issued to have Agradaa transported from prison to attend hearings, especially in criminal or high-profile civil cases.

📍 Venue Change Not Mandatory – Only Chief Justice Can Consider Logistics

On whether the venue for Empress Gifty’s case should be moved closer to Agradaa’s prison, Boahen was clear:

“You can’t demand Empress moves her case for Agradaa’s convenience. The only recourse is for her lawyer to appeal to the Chief Justice, requesting special considerations due to incarceration.”

This means Agradaa’s legal team must formally request logistical accommodations, rather than expect any automatic adjustments to court locations or schedules.

🧾 Other Legal Cases Against Agradaa Will Continue

Obiri Boahen further disclosed that if Nana Agradaa is facing other charges in different courts, those proceedings will also move forward despite her being behind bars.

“If she has more pending cases in other circuit courts, they won’t be cancelled. The courts can issue a warrant of production for prison authorities to present her in court,” he added.
